Madras High Court directive to Tamil Nadu on Sivaji statue

The petitioner said a PIL was originally filed by an 83-year-old P.N. Srinivasan

Chennai: A contempt application has been filed in the Madras high court against state highways secretary Rajeev Ranjan for disobeying the court’s order relating to removal of the statue of thespian Sivaji Ganesan from the Kamaraj Salai-Radhakrishnan salai junction here.
A Division bench comprising Justices Satish K. Agnihotri and K.K. Sasidharan before whom the contempt application filed by P. Nagarajan came up for hearing directed
government pleader S.T.S. Moorthy to get instructions and file an affidavit. The court posted the matter for August 19 for further hearing.
The petitioner said a PIL was originally filed by an 83-year-old P.N. Srinivasan, a follower of Mahatma Gandhi and social worker, against the installation of Sivaji statue in the middle of Kamaraj Salai, opposite Mahatma Gandhi statue.
During the pendency of the petition, Srinivasan died on September 7, 2013, and the petitioner substituted himself in the place of Srinivasan.
Statue affects motorists’ visibility: The authorities had filed their counter affidavits stating that because of the Sivaji Ganesan statue at this place, the visibility of motorists who were intending to take right turn to Dr Radhakrishnan Salai from Kamaraj Salai was affected.
The motorists who were intending to take right turn to Santhome high road from Dr Radhakrishnan Salai also have a chance to hit the motorists who were intending to take right turn to Dr Radhakrishnan Salai as the statue was obstructing visibility of motorists of both the sides.
They had also furnished details of accidents that took place including fatal accident in the year 2012 and 2013. Considering all this, this court had on January 23 directed the state highways secretary to take a decision regarding removal of the statue as expeditiously as possible. However, till date no action has been taken. Hence, the present contempt petition.
