Madras High Court declares NLC strike illegal, warns of action

The judge also issued statutory notice to S. Rajvannian, general secretary of NLC Workers Progressive Union
Chennai: Declaring the strike by two NLC trade unions as illegal, the Madras high court has directed the Neyveli Lignite Corporation (NLC) to initiate disciplinary and departmental proceedings against those who indulged in the strike.
Justice T. Raja gave the directive while allowing a sub-application from NLC, which sought to declare the strike by NLC Workers Progressive Union and NLC Anna Workers and Staff Union, from the third shift on July 20, 2015, as illegal.
The judge also issued statutory notice to S. Rajvannian, general secretary of NLC Workers Progressive Union and R. Udayakumar, secretary, NLC Anna Workers and Staff Union, on a contempt petition filed by NLC, which sought to punish the duo for willful disobedience of the order of the court, dated June 29.
In his petition, M. Maheswaran, chief regional manager of NLC, submitted that on a petition filed by NLC, the high court had on June 29 restrained the trade unions from going on indefinite strike from July 2 as indicated in their strike notices dated June 18, 2015, until further orders. Pursuant to the strike notice, the conciliation officer (The Regional Labour Commissioner) took up the issue (settlement of wage structure) for conciliation and conciliation was held on June 23 and July 9 and the conciliation officer also advised unions to refrain from resorting to the strike. Despite all these, the unions went on strike.
