Hyderabad: The Telangana government has decided to file a review petition in the High Court at Hyderabad with regard to certain observations made by a division bench in May on bifurcating the High Court.
TRS deputy floor leader B. Vinod Kumar told this newspaper that the review petition was necessitated as a division bench had questioned the location of the HC in Telangana, the Telangana government’s plea for shifting the location to Gachibowli and certain other comments.
“Since Hyderabad was made the joint capital for a period of 10 years as per the AP Reorganisation Act, the AP administration, High Court and other offices were located in Telangana. AP will have to move out once they have their own buildings. We want to put the record straight on the issue and also ensure AP sets up its High Court without further delay,” Mr Vinod said.
Asked whether the state government has any plans to move the Supreme Court, he replied in the negative.
On the Centre’s response to the stalling of the Lok Sabha by the TRS, he said Union law minister Sadananda Gowda had spoken to party MPs and assured that the process would be speeded up.
“Ultimately, the onus is on the Centre. It has to take steps to set up the High Court for AP. The Union Cabinet has to take a decision and send the same to the President for approval. Once the state is bifurcated, Telangana and AP should have separate High Courts,” he said.
To a query, he said the protests by TRS MPs would continue till the Centre initiates concrete steps for the bifurcation of the High Court.
It might be recalled that a division bench of the Hyderabad High Court headed by the then Chief Justice Kalyan Jyoti Sengupta pronounced judgement for the constitution of a High Court for AP within six months.
Mr T. Dhangopal, a social activist, the Andhra Pradesh High Court Sadhana Committee and others had filed petitions seeking separate High Courts for AP and Telangana.
The court had said that the Constitution does not permit having the AP High Court in Hyderabad which is an integral part of Telangana State and it also disapproved of the shifting of the Telangana High Court to Gachibowli.
