Can we direct Speaker, asks Hyderabad High Court

Hyderabad: The Hyderabad High Court on Wednesday inquired whether it has the jurisdiction to direct either the Assembly Speaker or the Legislative Council Chairman to expedite the hearing of petitions pending before them for disqualification of MLAs and MLCs.
A division bench of acting Chief Justice Dilip B. Bhosale and Justice S.V. Bhatt was hearing petitions by TD and Congress leaders.
TS TD floor leader E. Dayakar Rao had sought a direction to the Speaker to expedite hearings on the disqualification of three party MLAs — Talasani Srinivas Yadav, Teegala Krishna Reddy and Challa Dharma Reddy — who had defected to the TRS.
Congress MLA Sampath Kumar sought disqualification of MLAs Kale Yadaiah, D.S. Redya Naik, G. Vittal Reddy and K. Kanakaiah for joining the TRS.
The Congress Whip in the Council, M.S. Prabhakar Rao, urged the court to declare action of the Chairman in not fixing a date for hearing of his application seeking disqualification of MLCs K.R. Amos, V. Bhoopal Reddy, N. Rajalingam, T. Bhanu Prasad Rao and S. Jagadiswar Reddy as illegal.

The bench said the decision on the disqualification of MLAs was within the domain of presiding officers, but wanted to know whether the court had any power to direct them with regard to expediting the hearing and disposal of the petitions.
The bench asked counsel for the petitioners to show judgements of the Supreme Court or any provision under the statues in this regard.
Counsel representing the TS Advocate-General urged the bench to adjourn the matter as the law officer was unable to appear before the court. The court adjourned the hearing to Thursday.
Telugu Desam tells speaker to disqualify defectors
A TS TD delegation on Wednesday submitted a fresh representation to Speaker S. Madhusudana Chary seeking action under the anti-defection law against five TD MLAs who had shifted loyalties to the TRS without resigning from their membership of the House.
The delegation, led by TS TD president L. Ramana and Legislature Party leader Errabelli Dayakar Rao, said that no action had been initiated on their previous petitions.
They said MLAs T. Srinivas Yadav (Sanatnagar), T. Krishna Reddy (Maheswaram), Madaram Krishna Rao (Kukutpally), Manchireddy Kishen Reddy (Ibrahimpatnam) and C. Dharma Reddy (Parakal) had been admitted into the TRS by CM K. Chandrasekhar Rao.
They pointed out that Mr Srinivas Yadav had claimed that he had resigned as TD MLA, but the letter had not yet reached the Assembly Secretariat. They requested the Speaker to disqualify the defector MLAs and uphold the Constitution.
