Madras High Court: Answer queries on N-emergency in Maps
Authorities have failed to comply with the guidelines
Chennai: The Madras high court has directed the National Disaster Management Authority (NDMA) to answer queries relating to implementation of the guidelines on Management of Nuclear and Radiological Emergencies with regard to Madras Atomic Power Station (Maps), Kalpakkam in Kancheepuram district.
A division bench comprising Chief Justice Sanjay Kishan Kaul and Justice T. S. Sivagnanam gave the directive while passing interim orders on a PIL filed by advocate M. Vetriselvan, which questioned the failure of authorities to implement the National Disaster Management guidelines with regard to Maps.
Specifically listing out four guidelines regarding medical preparedness, M. Radhakrishan, counsel for the petitioner submitted that the authorities have failed to comply with these guidelines.
The bench said, “We may notice that as per para 9.4 time frames have been laid for implementation of the guidelines and keeping the same in mind, it has only to be verified whether the apprehension expressed by the petitioner in the four aforesaid aspects has any basis or not, especially as the three year period given for implementation of the aforesaid four aspects has already expired.
Since, the guidelines have been designed by the NDMA, it would be appropriate that the answer to these queries may be given either by the NDMA or Disaster Management and Mitigation, who are the concerned persons. Let the affidavit be filed within 6 weeks. List for compliance on September 1, 2015”.
