CJI speaks against Madhya Pradesh judges
New Delhi: Sanjay Singh Yadav, another Vyapam scam witness whose death was reported on Thursday, was reportedly suffering from Hepatitis-B. The constable was expected to appear as a witness in the examination and recruitment scam case.
On Thursday, a three-judge Supreme Court bench that comprised Chief Justice H.L. Dattu and Justices Arun Mishra and Amitav Roy criticised the Madhya Pradesh high court for washing its hands off the case and lobbing the ball back to the Supreme Court by not hearing the application filed by the MP government. The CJI said: “The HC judges could have done something on this application.”
As a battery of lawyers led by Kapil Sibal began their submissions, attorney-general Mukul Rohatgi told the court that he had instructions from the Madhya Pradesh government for the handing over of the probe and of all cases to the CBI.
When Mr Sibal pleaded that the high court should be restrained from taking up these cases, the CJI told the counsel: “Once we pass the order transferring the cases to the CBI for probe, the high court will not touch these cases.” Mr Sibal drew the court’s attention to the number of deaths taking place linked to the scam and said that high dignitaries, including the governor, were involved in the scam.
