Madras High Court orders notice to TNPSC over judge's appointment

Court has directed the TNPSC to file its reply by July 13

Chennai: The Madras high court has ordered notice to the Tamil Nadu Public Service Commission (TNPSC) on a petition seeking to re-publish list of the candidates selected for appointment as civil judges after excluding five candidates from the General Turn PSTM (Persons Studied in Tamil Medium) category who have not obtained the requisite minimum marks. A Division Bench comprising Justices V. Ramasubramanian and T. Mathivanan, before which a petition filed by an advocate K. Nandini, an aspiring candidate, came up, has directed the TNPSC to file its reply by July 13. According to the petitioner, the TNPSC had proposed to appoint 151 civil judges in Tamil Nadu State Judicial Service.

The candidates were selected based on the marks obtained by them in the written examination and viva-voce. The written examination was conducted on November 1 and 2 last year.Based on the results, 590 candidates were called for certificate verification and interview was conducted in TNPSC office. A panel of five judges of Madras high court conducted the interview. Subsequently, a final rank list of 151 candidates was published.

She contended that the rank list had been published erroneously by filling up candidates belonging to General PSTM Category. As a result of this she was kept out of the provisional selection list. The PSTM Category was created vide a G.O of September 30, 2010 according special reservation to the Persons Studied in Tamil Medium (PSTM). She alleged that five candidates, who were included in PSTM category had not obtained the minimum prescribed marks of 40 per cent.

Hence, they were not qualified to be considered under this category. Due to this, she was not selected. Hence, she sought the court to re-publish the list and sought for astay of operation of selection based on the rank list.
