States get 4 weeks for affidavits

Hyderabad: A division bench comprising acting Chief Justice Dilip B. Bhosale and Justice S.V. Bhatt of the Hyderabad High Court on Tuesday directed the state governments of Andhra Pradesh and Telangana to file counter affidavits on the plea of continuing the service of High Court employees up to 60 years of age.

The bench was dealing with a batch of petitions by High Court employees seeking to set aside the proceedings issued by the registrar general, informing about their retirement on attaining the age of 58.

They contended that the proceedings were issued contrary to the provisions of the Andhra Pradesh Public Employment (Regulation of age of superannuation) Act, 1984.

They said the age of superannuation was governed by the Act, and after amendment to the said Act with effect from June 27, 2014, members of the High Court service were entitled to continue in service up to 60 years of age.

The bench, while issuing notices to both the governments, granted four weeks for filing counter affidavits.
