Legal dispute in Shivas trademark settled amicably
Chennai: The legal battle between the Scottish liquor major Chivas Holdings and Coimbatore-based Shiva Distilleries Limited over trademark ’Shivas’ has been settled. The Intellectual Property Appellate Board (IPAB) bench comprising its Chairman Justice K.N. Basha and Technical Member -Trade Marks, Sanjeev Kumar Chaswal has disposed of seven petitions after the two companies settled the dispute out of court amicably.
The dispute related to the trade mark ‘Shivas’ and all the ‘Shivas’ formative trademarks, in which ‘Shivas’ is part of the name. The counsel for the applicant Ms. Mamta Jha informed the Intellectual Property Appellate Board (IPAB) that all these matters were amicably settled between the parties on the file of the Delhi High Court as per the order dated May 14, 2015.
Shiva Distilleries gave undertakings to Chivas Holdings and in view of this, Chivas Holdings agreed not to press for the relief of damages claimed in the suit. Counsels for the parties stated that they will remain bound by the obligations undertaken by them and recorded in the compromise application. The other details of the settlement were not disclosed in the order.
