Tribunal gives clean chit to Pachauri
New Delhi: In a big relief to Dr. K. Pachauri in the sexual harassment complaint given against him by an employee of the Energy and Resources Institute (Teri), the Industrial Tribunal, Karkadooma courts in the capital has stayed the report of the Internal Complaints Committee and restrained Teri from taking any action on the basis of the report.
The Tribunal stayed the findings on a petition filed by Dr. Pachauri challenging the panel’s report. In a brief order the Tribunal said “the counsel has taken me through the enquiry report of the committee and has pointed out that principles of natural justice have not been followed at all by the said committee” and said it was contrary to Rules.
While issuing notice to the respondents returnable on July 15, the Tribunal stayed the operation of the report. In his appeal, Dr Pachauri told the Tribunal that the report had exposed serious procedural errors, factual inaccuracies, legal lapses and prejudicial conduct by the ICC and it was based on conjectures and surmises.
He stated that he was prevented from sufficiently defending himself because the ICC withheld anonymous statements from unknown witnesses.
