Mysuru rape case: Prabhudha’s bail plea put off till tomorrow

The bail petition of Prabudhdha Harsha Murthy was put off to April 29 by the 4th and 7th Additional District and Sessions Court Judge

Mysuru: The bail petition of Prabudhdha Harsha Murthy, the brother-in-law of a retired IAS officer’s daughter who has accused him of rape and attempt to murder, was put off to April 29 by the 4th and 7th Additional District and Sessions Court Judge after Public Prosecutor Mahanthappa could not appear before the court.

The Public Prosecutor, who had filed his objections to the bail plea, had to rush to Virajpet on another case. Mr Arun Kumar, the advocate for the accused, argued that the rape statement by the complainant is concocted.

“It is a false and frivolous complaint. It is an offshoot of failed property negotiations by the complainant’s husband and her parents. The accused has a share in immovable property worth crores and is a practicing doctor at BM Hospital. The court can impose whatever conditions, but should grant him bail,” he said.

Picking holes in the complaint, he said, “The complainant’s husband was staying at home when the alleged incident took place. When she supposedly started shouting, it would not have taken a few seconds for him to climb the steps to reach the room, where the alleged incident took place. Moreover, it is impossible to commit rape within those few seconds.”

Mr Arun Kumar said that the last page is missing from the copy of the complaint that was sent by the Indiranagar police to V.V. Mohalla police. “The parents of the accused, Mr and Mrs C.B. Murthy, cannot be booked under Section 114 for abetment to crime, as Mr C.B. Murthy was not at the house when the alleged incident occurred. The complainant mentions that her husband called his father, who was in the hospital,” he said.
