Marina Loop road case shifted to Delhi NGT

The decision to shift the case to New Delhi was taken during last hearing held early this month
Chennai: In an unexpected development, National Green Tribunal (NGT) — Southern Bench — that was hearing Chennai corporation’s Marina Loop Road Project transferred the case to NGT, principal bench, New Delhi, on Friday. The principal bench will hear the case on May 1. There is a controversy attached to the decision as Justice M. Chockalingam, judicial member of court-1, reportedly lost his cool and transferred the case to the principal bench.
In fact, the decision to shift the case to New Delhi was taken during last hearing held early this month. A source present in court room during the last hearing told Deccan Chronicle on the condition of anonymity that the judge took objection to petitioner’s counsel A. Yogeshwaran viewpoint that an appeal challenging Coastal Regulation Zone (CRZ) clearance given to Loop road project is pending before court-2 of the same southern zonal bench and can’t be seen as separate cases.
Justice Chockalingam reportedly questioned the counsel on the need to file a separate case on the same matter before another court of the same zonal bench and expressed unwillingness to hear the case. He told the petitioner’s counsel that he is referring the case to NGT — principal bench before adjourning the matter to April 24. In response, the principal bench agreed to take up the case and listed it on May 1. Corporation officials, however, claim the work was being carried out as per the rules.
