Hyderabad high court quizzes Telangana on Parliament Secretaries

Govt counsel sought time saying the state advocate general will appear in the case

Hyderabad: A division bench comprising Chief Justice Kalyan Jyoti Sengupta and Justice P.V. Sanjay Kumar of the Hyderabad High Court on Thursday sought to know from the Telangana government whether it had vested power to make appointments of Parliamentary Secretaries in the state.

The bench was dealing with a petition by Nalgonda MP, G. Sukender Reddy, challenging the constitutional validity of Telangana Parliamentary Secretaries (appointment, salaries, allowances and miscellaneous provisions) Ordinance, 2014.

He urged the court to suspend its operation. The government has appointed MLAs D. Vinay Bhaskar, Jalagam Venkat Rao, V. Srinivas Goud, G. Kishore Kumar, V. Satish Kumar and Kova Laxmi as parliamentary secretaries.

The petitioner’s counsel contended that the Ordinance directly offends the constitutional provision contained in Article 164 (1A) and it was bad in law for delegation of essential legislative function.

Intervening, the bench asked the government counsel to explain about the powers which made the government make such appointments.

The government counsel sought time saying that the state advocate general will appear in the case. The bench posted the matter to Friday.
