Formulate norms for inter-state arrests, petitioner pleads in Madras High Court
Chennai: Petitioner S. Thangam of Vyasarpadi told the Madras high court on Monday that several others including Mohammed Rafi and S. Sahul from Chennai were arrested by AP police. In the case of Sahul, police claimed that he entered Chittoor forest and robbed red sanders. He pointed out that on July 14, 2014, the day of alleged offence, Sahul was in Dubai.
N. Anand of Red Hills and Zahir Hussain, an advocate in Madras high court, also filed similar complaints before the court. However, the Andhra Pradesh police had not stopped their illegal activities of detaining innocent persons from Tamil Nadu.
Andhra Pradesh police seem to be breaking the federal provisions enshrined in the Constitution. He sent petitions to authorities including Central and state governments directing the DGP, Andhra Pradesh to prevent arresting persons from Tamil Nadu and to conduct inquiry into the illegal arrest of persons hailing from Tamil Nadu by Andhra Pradesh police in the pretext of cutting and smuggling red sanders.
He also sought the court to formulate appropriate guideline for effecting inter-state arrest and release innocent persons arrested in connection with the charges. The first bench comprising Chief Justice Sanjay Kishan Kaul and justice T.S. Sivagnanam, before which the matter came up for hearing on Monday, posted the matter to June 9 for further hearing.
