BBMP Trifurcation: No easy task to split assets, liabilities

Bengaluru: The controversial trifurcation of BBMP does not find a mention in the amendment bill passed by the Legislative Assembly on Monday, but merely states that the number of divisions would be specified in a notification to be issued later on.
In the statement of objects and reasons of the amendment bill, the government has stated that for effective administration in Bengaluru, a committee of experts has recommended trifurcation of BBMP. Therefore, BBMP would be split into two or more corporations.
The bill, The Karnataka Municipal Corporations (Amendment) Bill, 2015, states: “Reconstitution of larger urban area of the corporation of the city of Bengaluru shall cease to exist with immediate effect and the name BBMP will be deleted. From the date of ceasure, all assets and liabilities vested in BBMP, until it is reconstituted, vests in the government. The Governor will constitute such number of new corporations as recommended by the state government by a notification.”
Besides, the government plans to publish a draft of the gazette notification, giving an opportunity for people to file their objections and suggestions within a period of thirty days. After considering these objections and suggestions, the Governor would recommend that the state government effect suitable modifications before issuing a final notification.
After a division, the government would determine the quantum of assets and liabilities to be distributed among new entities. The budget estimates, assessment lists, valuations or measurements made under the rule before ceasure of BBMP would be made authenticate in the new bill. All debts, obligations and contracts made by BBMP before ceasure, would be deemed as made by new corporations.
And, all officials working in BBMP would be posted in the newly carved entities and all proceedings pending with BBMP transferred to the new entity. All appeals pending with BBMP would be disposed in local areas. All prosecutions instituted by or on behalf of BBMP shall be continued by new corporations, the bill states.
