Survey lease area of D K Aruna’s kin: Hyderabad High Court
Hyderabad: The Hyderabad High Court on Tuesday directed the Telangana state mines and geology department to cancel the lease allotted to the Road Tech Pvt Ltd owned by D.K. Snigdha Reddy, daughter of former minister D.K. Aruna, if it was found that the company is carrying out quarrying operations outside the area allotted to it.
While ordering the company to stop quarrying extracted from the site at Mannapur village of Tharrur mandal, Mahbubnagar district, the court directed the department to issue directions to all assistant directors to stop transportation of minerals if it was found that the operators are transporting minerals outside the lease area and without obtaining dispatch permits.
A division bench comprising Justice Dilip B. Bhosale and Justice A. Ramalingeswara Rao was granting interim orders on a plea by B. Krishna Mohan Reddy, ex-ZPTC member of Gadwal town. The government counsel told the bench that the firm has been undertaking quarrying operations not only within the lease area but also outside the area not leased out.
The bench ordered the director of survey and land records to measure the land allotted to the company for quarrying to the extent of one hectare in Survey No. 135 within 10 days and adjourned the case to March 26.
Meanwhile, a division bench comprising Chief Justice Kalyan Jyoti Sengupta and Justice P.V. Sanjay Kumar of the Hyderabad High Court on Tuesday expressed its disinclination to stop counting of votes of the election held on March 22, 2015, for filling the vacancy of the Graduates’ Constitu-ency of Hyderabad, Ranga Reddy and Mahbubnagar.
The bench was hearing a petition moved as a lunch motion by Silveri Srishailam challenging the Election Commission’s action in conducting the elections by “following unconstitutional procedures” for the graduates’ constituency in the Telangana State Legislative Council.
He submitted that the Chief Electoral Officer has accepted nominations from the ineligible for contesting as a candidate in graduates’ constituency which is patent infringement of Article 171(3)b of the Constitution. He urged the court to direct the authorities conduct re-election and, in the meanwhile, stop the counting of votes scheduled on March 25.
Stay on Wakf chief posting
Justice Challa Kodanda Ram of the Hyderabad High Court on Tuesday granted an interim stay on a GO issued by the Telangana State government, dated June 20, 2014, by appointing M.J. Akbar, IFS, as special officer to the State Wakf Board. The judge was dealing with a petition filed by Anwar-ul-Uloom Educational Association represented by Mahboob Alam Khan challenging the appointment.
The petitioner contended that the appointment was in violation of the provisions of the Wakf Act, 1995. While granting a stay, the judge issued a notice to the state government directing it file a counter-affidavit on the plea and adjourned the issue.
