CBI: Valakom case mishap, not assault
Kochi: The Central Bureau of Investigation on Monday filed a closure report in the sensational Valakom case stating that the school teacher suffered serious injuries in a road accident.
Additional SP CBI Y Harikumar filed the closure report seeking Ernakulam CJM Court to close the case as a hit and run case. Krishna Kumar, a schoolteacher, was grievously injured at Valakom near Kottarakara on September 27, 2011.
CBI in its final report made it clear that the injuries sustained by the victim were not due to any physical assault. “The injuries are due to a fall from a height or due to blunt force impact that occurred in the road traffic accident.
The victim's chances of falling from a height and sustaining injury were not found substantiated from the investigation and hence it is required to accept that these injuries were sustained in a road traffic accident and the incident is a hit and run case,” CBI submitted.
The CBI also submitted that the involvement of any particular person as alleged by the victim was not substantiated. The CBI, in its final report, sought a directive from the Ernakulam CJM court to close the case.
The victim spoke to his wife at 10:10 pm and thereafter he was found lying injured at Valakom junction at 10:35 pm by the police. There was no incoming and outgoing calls on his mobile number in between.
The victim was unable to clearly recollect as to how he reached Valakom junction or how he had traveled from Nilamel Junction to Valakom, though he had given contradictory statements to the police and doctor.
The victim stated to police that he had travelled in a KSRTC bus and got down in Valakom junction. While he had given a statement to the doctor that he was thrown out of an Alto Car by some miscreants.
In the statement given to the magistrate and then to the police while he was undergoing treatment in medical college hospital Thiruvananthapuram, he had mentioned that he was assaulted by unknown persons with weapons, on his way home.
The CBI also submitted that Jackson Varghese who claimed that he saw the incident was not true. Polygraph examination and brain mapping test of Manoj Kumar alias Munchiri Manoj and Jackson Varghese were conducted in FSL, Gujarat.
The test disclosed that Manoj Kumar alias Muchiri Manoj was neither involved nor had any knowledge about the incident as alleged by Jackson Varghese. The test results disclosed that false information was furnished by Jackson Varghese against Manoj Kumar pertaining to the incident," CBI stated.
