DMK moves Supreme Court on SPP issue in assets case
Mr Singh tried to subvert the rule of law and delayed the trial
New Delhi: DMK general secretary K. Anbazhagan on Friday moved the Supreme Court seeking a stay of the ongoing proceedings in the Karnataka high court in the appeals filed by former Tamil Nadu Chief Minister Jayalalithaa and three others against their conviction and four-year sentence in the Rs 66.50 crore disproportionate assets case till the issue of public prosecutor was decided.
In his appeal, Mr Anbazhagan pointed out that Mr Bhavani Singh was apointed as special public prosecutor only for the trial but he continued to represent the prosecuting agency, the directorate of vigilance and anti-corruption, Tamil Nadu, in the ongoing appeal proceedings.
Citing various instances, the petitioner said at every stage during the trial, Mr Singh tried to subvert the rule of law and delayed the trial by siding with the accused.
“He does not seem to take any firm stand on any issue which may affect the cause of the accused persons. He appeared in the bail applications before the high court without any special order. Though he was authorised to appear in the trial court there is no order authorizsng him to appear in the appeal after culmination of the trial,” said the petition.
Mr Anbazhagan said he had made a representation to the Karnataka Chief Justice detailing the allegations but till now no action had been taken.
His petitions for removal of Mr Singh had been dismissed and, hence, the present appeal. While seeking to quash the high court order, he sought repalcement of Mr Singh to argue in the appeal and an interim stay of proceedings till then.
