Chief Justice to rule on AP State Council of Higher Education and Telangana fight

Two judges referred a dispute over utilisation of funds to the Chief Justice

Hyderabad: Two judges of the Hyderabad High Court on Wednesday referred a dispute between the AP State Council of Higher Education and the Telangana government over utilisation of funds, to the Chief Justice.

The AP council had moved court against the State Bank of Hyderabad freezing its account in its Shantinagar branch here, at the behest of the TS government.

While this petition was pending before Justice S.V. Bhatt, the TS government moved a plea seeking to restrain the AP government and the APSCHE from operating bank accounts belonging to institutions specified in the Tenth Schedule of the AP Reorganisation Act.

The TS government contended that the AP council was not entitled to withdraw money from the bank, only the Telangana higher education council could use the funds.

The AP government said the decision by the SBH to freeze the account was taken without any notice being issued and was in violation of the procedure prescribed under Section 75 of the AP Reorganisation Act.

Both the judges asked the Registry to place the matter before the Chief Justice.
