Experts: Sue state to change the IT law

An IT employee can sue the state and challenge the IT Act

Hyderabad: Experts say that the only legal option for laid-off employees is the Constitution which gives every citizen equal rights. It is the state which has infringed on the right of these employees by giving IT firms a free hand and keeping them immune to labour laws, Employees’ Prot-ection Act and minimum wages law, say legal experts. There-fore, an IT employee can sue the state and challenge the IT Act for infringement of his/her rights.

Former Additional Advocate General, High Court of Andhra Pradesh, A. Satya Prasad, said, “The IT Policy of Andhra Pradesh, apart from giving many concessions to the IT sector, has also exempted it from labour laws, industrial laws and other protective measures. This gives IT professionals no bargaining power, no right to question, and no compulsory notice of three months or three months’ salary. However, since all citizens are governed by the Constitution of India and the Constitution provides equality before law, you can seek justice by suing the state for violating your fundamental rights by framing a faulty policy and also challenge the state’s IT Pol-icy.”
