‘Drop of the hat’ delays anger Supreme Court
New Delhi: Expressing concern, anguish and agony over the inordinate delay in the disposal of corruption cases, the Supreme Court has directed all trial courts in the country not to grant adjournments during trial at the “drop of a hat.”
Giving this direction, a bench of Justices Dipak Misra and Rohinton Nariman said: “Adjournments are sought on the drop of a hat by the counsel, even though the witness is present in court, contrary to all principles of holding a trial. The law requires special reasons to be recorded for grant of time but the same is not taken note of.”
Justice Misra said “The court has a sacred duty to see that the trial is conducted as per law. If adjournments are granted in this manner, it would be tantamount to violation of rule of law and eventually turn such trials into a farce.”
