Hyderabad High Court angered by misuse of power

Hyderabad: The Hyderabad High Court has noticed that wrong exercise of discretion, conferred on the civic authorities is one of the major causes for cases piling up before it.

In half a dozen recent cases in which the HC had delivered its final verdict, the officers were penalised for wrongly exercising their discretion.

The judges of the High Court noted that if the authorities rightly appreciate the rules and take appropriate decision, the burden on the courts will automatically come down.

Justice M. S. Ramachandra Rao, while allowing several petitions in recent times expressed deep displeasure at the authorities in wrongly exercising their discretion in granting permission for construction of houses, removing of encroachments and paying compensation to property owners.

In one case where the authorities of the Greater Hyderabad Municipal Corporation refused to regularise plots of a petitioner, the judge ruled the action of the authorities arbitrary.
Justice C.V. Nagarjuna Reddy, while dealing with cases of ration dealers in AP, observed that this Court has no hesitation to hold that the entire official machinery is misused and the power of the officials is abused, evidently, for extraneous reasons.

CBI asks Hyderabad High Court to vacate KVP stay

The Central Bureau of Investigation has urged the Hyderabad High Court to vacate the stay granted on the red corner notice against MP K.V.P. Ramachandra Rao who was indicted by a US court in the titanium mining licence scam. It may be recalled that in the red corner notice it was alleged that Dr Rao is wanted in a case of money laundering, bribery, and violations of Foreign Corrupt Practices Act. The High Court had stayed the notice in April 2014.

The CBI filed an affidavit contending that KVP had no right to move the HC against the notice issued by the Federal Bureau of Investigation; he can challenge the notice either before the US Court which has issued the notice or before the concerned extradition court in India.
