Man objects to land being given for bhavans

Hyderabad: A division bench comprising Chief Justice Kalyan Jyoti Sengupta and Justice P.V. Sanjay Kumar on Wednesday directed the Telangana state government to maintain status quo on construction of Komaram Bheem Adivasi Bhavan at Road No. 10, Banjara Hills.

The bench was dealing with a petition by one Ramesh Parsram Malani, a resident of the city who has challenged the action of the government in alienating or transferring the evacuee land in Banjara Hills, for a purpose other than the purpose of Displaced Persons (Compensation & Rehabilitation) Act, 1954.

Chief Minister K. Chandrasekhar Rao on December 11, 2014, had laid the foundation stones for Banjara Bhavan, Komaram Bheem Adivasi Bhavan and Babu Jagjivan Ram Bhavan at Road No. 10, Banjara Hills.

The petitioner contended that allotting the evacuee land to construct the above-mentioned buildings was illegal and unconstitutional.
While granting status quo, the bench directed the respondent authorities to file counter affidavits.

Ap deletes section from farm act
The Andhra Pradesh government on Wednesday submitted before the High Court that it has deleted Section 38, which was incorporated in the Act to remove the existing members and chairman of the agricultural market committees in the state.

A division bench comprising Chief Justice Kalyan Jyoti Sengupta and Justice P.V. Sanjay Kumar was dealing with a batch of petitions seeking to suspend the operation of the AP Agricultural Produce and Livestock Markets (Amendment) Act 2014.

The bench pointed out that the government has no power to remove the existing committees by amending the Act.

The government has already deleted the Section from the Act and it was notified in the Gazette. The bench declared the petitions as infractuous and closed the matter.

Centre told to consider lawyers’ plea
A division bench comprising Justice K.C. Bhanu and Justice Anis of the Hyderabad High Court on Wednesday directed the Centre to consider the representation of the Andhra Pradesh Administrative Tribunal Advocates’ Association made against chairman and members of the tribunal.

The bench was dealing with a petition by the advocates’ association, represented by its secretary C. Kalyan Rao, against the chairman seeking to declare that he is unfit to hold the post.

Sarsani Satyam Reddy, senior counsel arguing for the petitioner, submitted that the tribunal became defunct from December 24 to 26, 2014, as all the members of the tribunal went on leave and the Registrar of the tribunal issued a notification on December 23 asking the advocates to move matters that require urgency as House Motions before the chairman.

He contended that it was the first time in the history of the tribunal that all the members went on leave and it was unconstitutional.

Observing that judicial officers are required to function within the parameters of the Constitution, the bench disposed of the plea by directing the Centre to take action on the representation.
