Hyderabad high court: February 2013 order still binding on both states
The bench posted the case to two weeks after reopening of the court after Sankranti vacations
Hyderabad: While passing the order on removing unauthorised flexies, cutouts and statues of political leaders and celebrities in the two states, the Hyderabad HC bench comprising Chief Justice Kalyan Jyoti Sengupta and Justice P.V. Sanjay Kumar stated, “We are happy to note that the problem which we had pointed out has already been taken care of by the undivided AP state following the SC order by issuing a GO.”
The bench said that the GO had not only disallowed statues, but also construction of any such structures including cutouts.
The bench also observed: “Since the aforesaid GO was passed on February 18, 2013, it can be termed to be an existing law as on the appointed day. This is still binding upon both the states.”
The bench directed the commissioners of police in metropolitan cities in both the states, respective municipal authorities, DGPs and SPs to strictly adhere to the GO. While doing so they should identify statues, cutouts, flexi boards and photos installed illegally and in violation of the GO.
The bench ruled that after the identification of illegal installations, the authorities should remove them immediately. The bench posted the case to two weeks after reopening of the court after Sankranti vacations for compliance.
