Maintenance first, divorce later: Hyderabad High Court
Husband fails to obey order
Hyderabad: The Hyderabad High Court has ruled that payment of maintenance is a must to go ahead with the proceedings in a divorce petition pending before family courts.
Justice M. Seetharama Murti was allowing a contempt case moved by a wife against her husband for failing to pay the maintenance. He directed the family court not to proceed with the divorce proceedings pending before it un-less the husband pays interim maintenance to the wife.
A woman and her minor child moved the contempt case stating that the High Court had directed her husband to deposit the entire arrears of maintenance within three months in 2013. Still, the amount is pending. He had only paid a sum of Rs 11,350.
After perusing the material placed before the court, the judge directed the respondent husband to pay the arrears within one month from the date of receipt of a copy of this order.
The judge ruled that in the event of failure of the respondent to pay the arrears, he shall be detained in civil prison for one week. The judge observed that the very purpose of granting interim alimony is to ensure the helpless party some means of sustenance.
