BCI urges court to set aside single judge’s order

Hyderabad: A division bench comprising Chief Justice Kalyan Jyoti Sen Gupta and Justice P.V. Sanjay Kumar of the Hyderabad High Court on Friday directed the AP Bar Council to continue enrolment of advocates and its other functions.

While staying an order of a single judge, the bench m0ade it clear that the creation of a Bar Council of Telangana would arise only after a separate High Court for the state of Andhra Pradesh is constituted under Article 214 of the Constitution read with Section 31 of the AP Reorganisation Act, 2014 and advocate generals of both the states shall be ex-officio members of the existing common council.

The bench granted the interim order on an appeal by the Bar Council of India challenging the order of the single judge in directing the BCI and Centre to ensure that a separate Bar Council for the state of Telangana becomes operational.

The BCI submitted that it has no power to constitute the state Bar Council and it was the Centre which has the power to set up Bar Councils. The BCI urged the court to set aside the order of the single judge as the enrolments of advocates are stalled due to the order.

The bench told the existing council to proceed with the enrolments of law graduates by having separate registers and to continue disciplinary proceedings with regard to complaints against advocates. Seeking disciplinary action shall not to be finalised till further orders.
