AP government foned for not implementing order

Hyderabad: A division bench comprising Chief Justice Kalyan Jyoti Sengupta and Justice P.V. Sanjay Kumar of the Hyderabad High Court on Thursday fumed at the authorities of the higher education department of AP for not implementing court order since 2005.

The bench was dealing with a contempt case moved by P. Sreenivasulu Reddy, a part time lecture in Jawahar Bharathi degree college, stating that the High Court in the year 2000 passed an order for regularisation of his service and a division bench also upheld the order in an appeal by the government in 2005.

He said in 2005 the court granted six weeks time to the authorities, but till date they have not implemented the order.

In an earlier occasion, the bench ordered the presence of the commissioner and director of the higher education and accordingly the official appeared before the court on Thursday.

When Justice Sengupta asked for the reasons, the official sought four weeks time to look into the facts of the case.

Reacting to the request, the Chief Justice pointed out that the contempt case was pending for the last two years and whenever this case came up for hearing, the authorities were seeking adjournments by showing one or the other reason and this kind of attitude cannot be permitted.

When the bench took a serious view against the official, the advocate general intervened and submitted that the official was prepared to tender an unconditional apology to the court.

The bench said that if the official tender an apology in written then they will consider the case and also implement the order by Saturday and report compliance to the court.

The bench ordered the state government to pay Rs 4,000 fine for not implementing the order and later deduct the amount from the pocket of the officers responsible for not implementing the order.
