Work to begin only if compensated: Kerala High Court

HC stalls work opposite to Lisie Hosp, Kaloor

Kochi: The Kerala High Court on Tuesday asked Kochi Metro Rail Ltd to stop construction of a Metro Station near Lissie Hospital after a land owner moved the court seeking compensation.

Justice K Surendra Mohan issued the interim order on a plea seeking a directive to Kochi Metro Rail Limited not to go ahead with any construction in the acquired land near Lissie junction for the Kochi Metro Station.

The court was considering a plea filed by Kumari Sebastian of Nedumbassery, a petrol pump owner, seeking a directive against the order to acquire the land.

The court stopped the construction work till the government paid 80 percent of the estimated amount of compensation with an interest rate at 15 percent.

The petitioner argued that the land was acquired without paying the market value. The petitioner was given only Rs 40 lakh per cent while the market rate is Rs One crore.

The land was acquired under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act. An extent of 25.34 cents of land were taken by the District Administration.
