Hyderabad: The Supreme Court on Monday adjourned a Special Leave Petition filed by the Telangana government seeking a fresh hearing by the Justice Brijesh Kumar Tribunal to provide a fair share in the Krishna River waters to February 11 and ordered Maharashtra, AP and Karnataka to file their objections to decide their admissibility.
The bench of Justice Vikramajit Sen and Justice Prafulla C. Pant heard the TS’s arguments and the objections raised by Maharashtra and Karnataka counsels against the SLP.
In view of the objections by TS, the bench said it would decide the SLP’s admissibility and ordered riparian states to state their objections in writing.
The Telangana government in its SLP said that in view of the bifurcation of AP and as Telangana constitutes a large area of the Krishna River basin and as no specific quota has been awarded by the Justice Brijesh Kumar Tribunal, it has every right to seek a fair share now since the state is newly formed.
It also mentioned that in page No: 132 of the final clarifications issued by the Justice Brijesh Kumar Tribunal in 2013 it was specifically mentioned that in case of any modifications or alterations or fresh allotment of Krishna waters the entire water distribution among all states should be taken as a single unit.
The Telangana government has already filed similar petitions before the Centre under Section 3 of the Inter State River Water Disputes Act and before the Justice Brijesh Kumar Tribunal under Section 89 of the AP Reorganisation Act seeking a fair share in the Krishna waters exclusively for the use of Telangana.
