Hyderabad High Court: File report on boy burned in Army area
Hyderabad: A division bench comprising Chief Justice Kalyan Jyoti Sengupta and Justice P.V. Sanjay Kumar of the Hyderabad High Court on Monday directed the Hyderabad city police commissioner to submit a status report on the investigation into the killing of 11year old Shaik Mustafauddin in Army Garrison campus at Mehdipatnam of the city.
The bench was dealing with a Gulam Rabbani, an advocate from the city seeking a direction to the Telangana state government to hand over the case to the CBI for an impartial probe as the police has not made any progress in the case till date.
He contended that unless the investigation was entrusted to the CBI, there will not be fair and impartial probe and he urged the court to permit him to implead the Centre also one of the respondents to his plea.
Shaik Mustafauddin, a resident of Siddique Nagar near Mehdipatnam, had succumbed after he was set on fire on October 8, 2014. The boy, in his dying declaration, had said that two Army men set him ablaze.
No order on TS number plates
The TS government on Monday informed the Hyderabad HC that it has issued a GO inviting objections and suggestions from the public with regard to reassignment of registration number and it was only a preliminary notification and no final decision was taken on the issue. Sanjay Kumar was dealing with a petition by J. Rammohan Chowdary challenging the notification seeking to change all the number plates of all vehicles in the state.
A. Sanjeev Kumar, special government pleader, informed the court that all number plates are not being changed, but only the letters ‘AP’ were sought to be replaced by letters ‘TS’.
He said a final notification would be issued after receiving views from the public, including that of the petitioner.
The bench recorded the statement and closed the case by granting liberty to the petitioner to pursue the issue if he is still aggrieved with the final decision of the government in this regard.
TS opinion on panel sought
A division bench comprising Chief Justice Kalyan Jyoti Sengupta and Justice P.V. Sanjay Kumar of Hyderabad High Court on Monday directed the Telangana state government to inform it in a week about the steps being taken to make appointments to Telangana State Consumer Dispute Redressal Commission.
The bench was dealing with a petition by K. Visweswara Rao challenging the inaction of the government in appointing the president and two members to the Telangana State Consumer Disputes Redressal Commission as per provisions of the Section 16 of the Consumer Protection Act, 1986.
He submitted that the government issued the GO on October 15, 2014 by constituting the State Forum , but it has failed to appoint the chairman and members to the commission. Due to this the commission had become non functional and the existing AP State Commission was not taking up the consumer cases pertaining to the Telangana.
HC asks why object to loan waiver
A division bench comprising Chief Justice Kalyan Jyoti Sengupta and Justice P.V. Sanjay Kumar of the Hyderabad High Court on Monday asked a petitioner to explain his objection to the farm loan waiver scheme of the Telangana and AP state governments.
The bench was dealing with a plea by Mr J. Rammohan Chowdary challenging the GOs issued by the Telangana and Andhra governments to waive farmers’ debts.
The petitioner contended that the action of both governments was unconstitutional and also against the interest of food security of nation.
Justice Sengupta asked why the petitioner was objecting to the scheme when banks were implementing it in the interest of the farming community.
The petitioner said that if the scheme was allowed, it would discourage small, marginal and tenant farmers with implied tenancy, and youngsters not having their own farmland, to take up agriculture as a livelihood.
The counsels representing both the states submitted that the Bench had earlier dismissed a similar petition.
Justice Sengupta asked the counsels to place the order before the Bench and adjourned the hearing to Tuesday.
