Hyderabad: The Bar Council of India on Thursday submitted before the Hyderabad High Court that it has no powers to constitute a Bar Council for any state.
Senior counsel D. Prakash Reddy who was arguing before a division bench comprising Chief Justice Kalyan Jyoti Sengupta and P.V. Sanjay Kumar for the Bar Council of India said that it was only a regulatory body to monitor the functions of state Bar Councils.
He said only the Centre has powers to constitute a separate Bar Council for the new state of Telangana.
The Hyderabad High Court bench was hearing an appeal by the Bar Council of India challenging a single judge order directing it to take immediate steps to ensure that a Bar Council becomes operational for the new Telangana state.
The counsel said that due to the judgement issued by the single judge advocates were not being enrolled into the existing state Bar Council.
Senior counsel S. Satyam Reddy, who was appearing for the petitioners said that as per the Andhra Pradesh Reorganisation Act, a separate state Bar Council has to be constituted for the new Telangana state once an Appointed Day was fixed for creating the state.
