Non-performers can be thrown out: Madras high court

Madras High court bench was shocked to hear that inspite of stop notice work was still going on
Chennai: Stating that it cannot be the function of the court to supervise each administrative action of the Chennai corporation, the Madras high court said on Tuesday that if corporation officers were incapable of performing their duties, it is better they are dispensed with from the department. A division bench comprising Chief Justice Sanjay Kishan Kaul and Justice M. Sathyanarayanan also directed the Chennai corporation commissioner to file a status report with regard to an unauthorized construction being put up in Kottur, despite a stop work notice issued by the corporation.
Passing interim orders on a public interest litigation from R. Narasimhan, the bench said that it was shocking to learn that despite the representation of the petitioner and a stop work notice, the allegation was that work still goes on and thus a PIL had been filed. “We call upon the counsel for the Chennai corporation commissioner to file a status report within three days and let the relevant officer who issued the stop work notice remain personally present in the court. Let notice be also issued to S. Ravi (who has allegedly put up construction in his plot without any approval from authorities in Kottur). Post the matter on December 3,” the bench added.
According to the petitioner R. Narasimhan, a resident of Kottur, originally, Ravi, a known encroacher, started construction in his plot without any approval from the authorities concerned. Even after representations were made on March 28 to the corporation, Ravi continued the unauthorized construction. After repeated representations, officials of the Chennai corporation made a site inspection and issued a stop work notice on October 30. But Ravi was still continuing with the illegal construction. Therefore, he filed the present PIL, he added.
