Kerala High Court flays KSRTC inaction

HC severely criticised the Kerala State Road Transport Corporation
Kochi: The Kerala High Court on Monday severely criticised the Kerala State Road Transport Corporation for not taking action against the officials who delayed to compensate a commuter invovled in road accident twelve years ago. The court observed that it was not imposing any legal cost on the corporation considering its current financial status.
The court was considering a review petition filed by the corporation against Abdul Wahab of Alappuzha. The court found that KSRTC had failed to produce the insurance policy before the Motor Accidents Claims Tribunal, Alappuzha, which resulted in the tribunal ordering the corporation to issue a compensation of Rs 14,000 in 2007. Wahab met with an accident in 2002.
Interestingly, the corporation produced the copy of an insurance policy before the High Court when the review petition came up for hearing. Considering this Justice K.VInod Chandran observed: "If a valid insurance policy was available, the same ought to have been produced before the tribunal when the case was pending.
Even after several years the authorities failed to resolve the issue. The court further observed that the corporation which time and time again claimed financial stringency in paying even pension to its employees, had behaved in abject levity and callousness.
