Telangana, Andhra Pradesh to come under AP Administrative Tribunal
Hyderabad: The Centre on Tuesday submitted before the Hyderabad High Court that the AP Administrative Tribunal will have territorial jurisdiction over both the successor states of Andhra Pradesh and Telangana for a period of two years from the Appointed Day.
The Centre filed an affidavit before the court stating that pursuant to enactment of the AP Reorganisation Act, 2014, the matter regarding territorial jurisdiction of the Tribunal over the both the states has been crystallised in consultation with the department of legal affairs, taking into consideration the provision of Section 101 of the Act.
A division bench comprising Chief Justice Kalyan Jyoti Sengupta and Justice P.V. Sanjay Kumar was dealing with petitions questioning the jurisdiction of the APAT with regard to service matters of employees of Telangana State government after bifurcation of Andhra Pradesh.
It was submitted that the Andhra Pradesh government had sought a clarification from the Centre with regard to jurisdiction of the Tribunal and the AP government and the law department of the AP agreed with the advice given to it by the Centre regarding jurisdiction of APAT over the state of Telangana.
Referring to the demand of Telangana State to set up a separate tribunal, the Centre submitted that the successor Telangana state may request the Centre for constitution of the tribunal, but so far no such proposal has been received by it.
