HC asks sports secretary to manage RCA affairs for three weeks

Lalit Modi faction had filed a case in Rajasthan High Court against Pathan, RCA vice-president

Jaipur: Rajasthan High Court on Friday appointed state sports secretary J C Mahanti to manage the day-to-day affairs of Rajasthan Cricket Association for three weeks after Lalit Modi faction filed a case challenging their rival group's "forcible" taking over of RCA offices.

Justice M N Bhandari passed the order after hearing a petition filed by Mehmood Abdi, Modi's close aide and Deputy President of RCA, and 11 others. The single judge also issued notices to state government and self-styled RCA president Amin Pathan.

The Modi faction had filed a case in Jaipur bench of the High Court against Pathan, a vice-president of the association, and his aides for "forcibly" occupying the RCA offices after allegedly removing the former IPL commissioner. Pathan had said that he had taken over as acting president, but the Modi faction disputed the legitimacy of Pathan's group.

Abdi had alleged that the "so called EGM was illegal and it appeared that false and fabricated documents signed by unauthorised and fictitious persons have been prepared by respondents showing them as representatives of the District Cricket Association to make a claim."

"There is no provision of any no confidence motion in Rajasthan Sports Act. Article 19A requires 3/4th majority of the voting members to pass such a resolution and a quorum of 2/3 members," Abdi said.

Abdi has pleaded that the proper security should be provided to the petitioners and an enquiry may be initiated against respondents for allowing wrongful possession of RCA offices.
