Hyderabad: Justice A. Ramalingeswara Rao of the Hyderabad High Court has permitted the police to go ahead with investigation and prosecution of office-bearers of the Jubilee Hills Cooperative House Building Society, Hyderabad, who allegedly resorted to fudging of records to dispose of seven public utility spaces in a prime location of Jubilee Hills.
The judge was dismissing a plea by V. Janardhan Babu and eight other office-bearers, who were shown as accused in a case registered by the Jubilee Hills police in 2002 on alleged irregularities in the Society.
According to the petitioners, they were elected as office-bearers of the Society in November 2000. The Cooperative Department and Vigilance and Enforcement Department conducted an inquiry against them based on some frivolous allegations by vested interests that they had disposed of seven places earmarked for public purpose on lease for 50 years.
They submitted that the lands were leased to the parties after inviting tenders and the money transactions were made through cheques and despite the fact, that the inquiry officers gave false findings.
They told the court that based on the findings of the inquiry, Jubilee Hills police registered a case against them. When, this came up for hearing, on the last occasion, the judge asked the Cooperative Department and police authorities to produce the records.
Accordingly, the authorities produced the records and after perusing the records, the judge said that the allegations are serious in nature and a full fledged investigation was necessary.
While dismissing the petition, the judge directed the police to complete the investigation according to law.
