Appeal to Karnataka High Court is top legal option for convicted
Chennai: AIADMK general secretary J.Jayalalithaa, convicted and sentenced to undergo four years of RI in the disproportionate wealth case, has no other remedy but to approach the Karnataka high court, seeking stay of conviction and sentence or suspension of the sentence and bail.
However, she may not get any remedy for at least one week since the Karnataka high court will be on Dasara holidays. But she can move the vacation court considering the urgency of the matter since her life and liberty is involved in it.
Since the sentence exceeded three years, special judge John Michael Cunha has no power to suspend the sentence. Therefore, she has to go to jail. Thereafter, she can file appeal before the appellate court for suspension of sentence.
