Sri Ramachandra Educational and Health Trust cannot put up buildings
7.44 acres of prime property in Tiruvanmiyur was sold to the trust for a paltry sum by the Tamil Nadu housing board
Chennai: The Madras high court restrained Sri Ramachandra Educational and Health Trust from putting up any construction on 7.44 acres of prime property in Tiruvanmiyur which was sold to the trust for a paltry sum by the Tamil Nadu housing board.
While passing an interim order on a writ petition from T. Kalaimani of Tiruvanmiyur, a social worker and advocate, Justice V. Ramasubramanian granted the injunction. Any construction activity carried out by the trust on the land would be at its own risk and it would not confer any right upon it, the judge said. If the trust carries on any activity, it cannot claim equity at the end of the day, the judge added.
The petitioner submitted that the Tamil Nadu housing board had acquired the land for an ambitious project, the Tiruvanmiyur Neighbourhood Extension. The board aimed to provide housing plots to middle and lower income groups in the area. The petitioner had applied for allotment of a plot under the public quota of social workers’ category in 2008.
The petitioner said he came to know that the board had, on July 1, 2014, passed a resolution to sell the land to Sri Ramachandra Trust as directed by the secretary, housing and urban development department.
A ground was sold for Rs 6,01,320 against the market price of Rs3 crore. The transaction was done in a secret manner without calling for public auction. It caused a huge loss to the state.
The execution of the sale deed at the south Chennai registration office at Saidapet was arbitrary and illegal. He prayed to the court to quash the allotment for this reason and also to cancel the sale dead.
