Chennai: Who violates the order of director general of police in the state? It is the police personnel working below the DGP, said the Madras High court.
Disposing of a contempt application filed by ‘Traffic’ K.R Ramaswmy, the first bench comprising Chief Justice Sanjay Kishan Kaul and Justice Pushpa Sathyanarayana, said that the irony is that circulars, including memorandum, dated September 10, 2005, issued by the DGP, were violated by the police force. The ostensible reason is stated to be that there is every chance of creation of unnecessary complications due to religious sentiments expressed by local residents.
The bench said that a violation had taken place is quite apparent from the fact that it is justified on the basis of 'religious sentiments expressed by local residents,’ while pleading that the festival season went off in an organised manner and that there was no obstruction.
The bench said that the origin of the contempt petition, which was related to an order dated August 28, 2013, was prohibiting erection of idols in public places. A reading of the order itself showed where the problem was. It is in that context it was observed, in the order, that it would not serve any purpose by issuing impractical directions.
The bench said we are of the view that the police authorities must well in advance look into the arrangements, which would be made and issue necessary circulars/modifications, but ensure that once they are in force, they are implemented in to and excuses of religious sentiments and public feelings are not put forward to violate their own circulars.
