M K Stalin seeks exemption from court presence in a defamation case
Jayalalithaa had filed a defamation case filed against him
Chennai: DMK treasurer M.K. Stalin filed a petition before a city court in Chennai on Wednesday, seeking exemption from his personal appearance in a defamation case filed against him by Chief Minister J. Jayalalithaa.
When the petition came up for hearing before principal sessions court judge N. Authinathan, the counsel for Stalin filed the petition under section 205 of the CrPC (magistrate may dispense with personal attendance of the accused).
On behalf of the Chief Minister, city public prosecutor M.L. Jegan filed the defamation case in the court on July 30 for speaking to reporters on July 22 in connection with the suspension of DMK MLAs from the Assembly.
In the petition, Jayalalithaa stated that she was not present in the Assembly on July 22. The court posted the matter to September 3.
The counsel for Stalin, Kumaresan, filed the affidavit, stating that Stalin, as a DMK functionary, was preoccupied with party work in various districts and his personal appearance in the proceedings would cause hardship.
Stalin would be present before the court as and when required. Later, judge Authinathan posted the matter to October 10.
