Partial relief for Kal Cables private limited
The union government in its letter dated August 20, 2014 cancelled the permanent registration
Chennai: The Madras high court has stayed a portion of the order of the Union government, which directed M/s Kal Cables Private Limited, whose permanent registration was cancelled by the government, to run a continuous scroll on the screen informing consumers that their services would not be available after 15 days (specifying date) so that subscribers could shift to alternate operators.
Justice V. Ramasubramanian granted the stay on a petition filed by Kal Cables Pvt Ltd, which sought to quash the order of the Union government, cancelling the permanent registration granted to it on the ground that the Union minister of home affairs had denied security clearance to the company.
The judge posted further hearing of the case to September 2. According to the petitioner, it was in the business of providing cable TV services in TN for the past 15 years. The union government in its letter dated August 20, 2014 cancelled the permanent registration, citing reasons that the union home ministry had denied security clearance to the petitioner.
The petitioner has not been called to show cause why security clearance be denied and was not at all put in notice of the
same. All of a sudden, the permission was cancelled without affording an opportunity which was against the principles of natural justice, the petitioner added.
