Bench upholds order calling decision to cut intake ‘void’
Hyderabad: A division bench of the Hyderabad High Court on Thursday upheld the order of a single judge in declaring the decision of the Jawaharlal Nehru Technological University to reduce the intake capacity of certain private engineering colleges as void.
A single judge on August 24 granted an interim order holding that the JNTU cannot reduce the intake capacity unilaterally.
The judge ruled that JNTU is to notify full intake capacity of the petitioners’ colleges sanctioned by the All India Council of Technical Education for the academic year 2014-15 and allow them to go ahead with admissions.
Aggrieved by the order, the JNTU had moved an appeal before the bench saying it has the power to reduce the intake capacity of seats despite approval from the AICTE.
The varsity said that the intake capacity was reduced by 180 students per branch because the colleges did not have adequate teaching staff.
While observing that the varsity had the power to reduce intake capacity when it found inadequate facilities in colleges, the bench ruled that the power is to be exercised only after following the due process stated in the regulations of the university.
Refusing to stay the order of the single judge, the bench said that the detailed order will be delivered within a day or two. The bench also directed that each of the colleges must submit a declaration stating that it will take steps to rectify the deficiencies pointed out by the JNTU.
