CAT tells Centre, Tamil Nadu to promote woman revenue divisional officer

Injustice needs to be redressed: Tribunal
Chennai: The Madras Bench of Central Administrative Tribunal directed the Central and state governments to promote a woman revenue divisional officer and include her in Indian Administrative Service with effect from 2012.
The bench comprising judicial member K. Elango and administrative member Dr P. Prabakaran said, “We are of the considered view that injustice done to the applicant requires to be redressed.”
In the petition, Mrs Asia Mariam, 38, submitted that she was recruited as deputy collector in 1997-98 and promoted as DRO in 2006 and that she has no offence, departmental or criminal proceedings against her in her 12 years of service. When the state government decided to fill 11 vacancies for IAS, she was not considered for the coveted post. Eight of her juniors were promoted.
She said, “Despite having satisfied eligibility conditions and standing fifth in the merit list”, she was not considered for the post by a notification dated December 27, 2013 of secretary, department of personnel, public grievances and pensions, Central government. She added, “I had outstanding records especially five years prior to the year of consideration. However, I was not promoted”.
In his reply, secretary, Tamil Nadu Public Special (A) Department submitted that as per an order of CAT and high court, her annual confidential reports were not treated as valid since they were written belatedly.
The bench directed the state government to forward the ACRs for the relevant period to Union Public Service Commission and directed the UPSC to convene a review committee meeting to consider the case of applicant. The bench directed the government to comply with the order in three months.
