Hyderabad High Court gives nod for fresh plea

HC granted liberty to a petitioner to file an interlocutory application seeking a stay on the proposed survey
Hyderabad: Justice Vilas Afzulpurkar of the Hyderabad High Court on Wednesday granted liberty to a petitioner to file an interlocutory application seeking a stay on the proposed Intensive Household Survey being conducted on August 19 by the Telangana State government.
The judge was hearing a petition filed by a city advocate Seetha Lakshmi, contending that her right to move freely and liberty under Article 19(d) and 21 of the Constitution will be infringed upon on the day as the state government asked every person to stay at home and had also declared a public holiday for the proposed survey.
Reacting to the submissions of senior counsel R. Raghunandan, appearing for the petitioner, the judge pointed out that there was no mention of the facts in the affidavit of the petitioner and the court will not look into the pleadings which are not a part of the affidavit and he would dismiss the plea.
Mr Raghunandan replied that the facts which he placed during his submission are subsequent developments after the filing of petition by his client. He urged the court to grant liberty to file an interlocutory application by bringing out subsequent developments.
The judge permitted the petitioner to file the fresh application by amending the prayer and brought to the notice of the subsequent developments and adjourned the case to Thursday.
