Supreme Court dismisses PIL on Leader of opposition issue

SC said it cannot decide political issues filed under the garb of public interest litigation

New Delhi: The Congress’ campaign for status of Leader of Opposition in the Lok Sabha received a major setback after the Supreme Court on Friday dismissed a PIL seeking that the status be granted to the Congress.

The apex court said it cannot decide political issues filed under the garb of public interest litigation. It also said that a “ruling given by the Speaker in the House is not amendable to judicial review”.

“Under Article 32, we are not sitting here to decide political issues,” the bench said. The bench pulled up petitioner M.L. Sharma for filing a PIL without doing proper “homework”. Mr Sharma submitted that the question of the Leader of the Opposition is to be read with the provision of Salary and Allowances of the Leaders of Opposition in Parliament Act, 1977.
