POSCO Act misuse? Woman alleges husband raped their baby

But doctor say injury on private parts may not be cause of sexual assault
Bengaluru: A teacher from a city school has filed a police complaint against her 35-year-old husband, alleging that he raped their seven-month-old daughter at their house in Subramanyapura on Monday.
The police have taken up a case under several sections of the IPC and the Pocso Act. The complaint stated that the woman had gone out, leaving the child with her husband in their house. When she returned, she found the baby crying incessantly. When she checked, she found an injury mark on the baby’s private parts. When she questioned her husband, he gave her evasive replies, she states in the complaint.
Not convinced with her husband’s replies and suspecting his behaviour, she lodged a police complaint, she states. She took the baby to Indira Gandhi Hospital for Children, where doctors examined and treated the child.
Sources from the hospital told Deccan Chronicle that though there was a superficial injury on the private parts of the child, it was yet to be confirmed whether it was because of a sexual assault.
Police sources said that after the preliminary investigation, it is suspected that there could be an ulterior motive behind the woman’s complaint. She could be trying to falsely implicate her husband, they said. However, as a rape complaint has been made, and as it involves a child, the police have filed a case under relevant sections and are investigating.
“We are yet to confirm whether it was a case of sexual assault. Based on the reports, we will take action against the man,” a senior police officer told Deccan Chronicle.
The child has been subjected to medical tests and the reports are still awaited. But the police claimed that the doctors, off the record, had told them that there were no signs of sexual assault on the child, like penetration or an attempt to rape. But the cause of the superficial wound on the child’s private parts is being investigated.
We recorded the statement of the doctor who examined the child before a magistrate on Wednesday. But to be sure, we are seeking the opinion of experts and sent certain evidence to the Forensic Sciences Laboratory (FSL),” said a senior police officer who is supervising the investigation.
