Madras High Court upholds CISF cop’s dismissal
Constable was dismissed for dereliction of duty for consuming alcohol
Chennai: Upholding the dismissal order of a constable of the Central Industrial Security Force (CISF) for dereliction of duty, consuming alcohol during duty hours and assaulting a senior officer in an drunken state, the Madras high court said the charges must be viewed seriously and such a person could not be shown leniency.
The division bench, comprising justices N. Paul Vasanthakumar and K. Ravichandrabaabu, said, “Consuming alcohol during duty hours and assaulting a co-officer under the influence of alcohol, are certainly to be viewed seriously, as they amount to grave misconduct.”
The petitioner, K. Loganathan, submitted that he was working as constable under the commandant, CISF unit, Vikram Sarabhai Space Centre, Thumba, Thiruvananthapuram. On May 16, 2008, he was issued a charge memo under rule 36 of CISF Rules 2001 for an act of indiscipline and dereliction of duty.
In the memo, the authorities stated that he did not report for duty on April 25, 2008. In drunken state, Loganathan manhandled reserve inspector Sohan Ram and other senior officers. He was known for persistently maintaining a blemished record during his 18 years of service.
