Krishna water dispute: Centre, four states told to file affidavits

States to file their affidavits on Section 89 of the AP Re-organisation Act

Hyderabad: Justice Brijesh Kumar Tribunal, constituted for the purpose of distribution of Krishna waters among the riparian states, on Thursday asked the Centre as also states of Maharashtra, Karnataka, Andhra Pradesh and Telangana state to file their affidavits on Section 89 of the AP Re-organisation Act, dealing with specific allocation of waters projects wise.

There was confusion among all the four states on the interpretation of Section 89 of the Act, while Maharashtra and Karnataka informed the Tribunal on Thursday that the Re-organisation Act only deals with residuary state of Andhra Pradesh and Telangana, hence any dispute with regard to Krishna water distribution should be settled among AP and Telangana only.

On Thursday, Brijesh Kumar informed the counsels of all four states that Section 89 did make a reference about project-wise specific allocations and even asked the Tribunal to do so if it has not done so previously and as such is binding on all the states.

However, responding to the suggestions of the counsels representing the States, the Tribunal chairman agreed to seek the Centre’s clarification on what they intended to do with Section 89 of Act.

Telangana State Advocate General K. Ramakrishna Reddy told the Tribunal that his government intends to re-open the Tribunal award by claiming its legitimate share in the Krishna water as a new state. The Tribunal directed all four states to file counters and exchange among themselves.
