Admission Row: Judge finds fault with NTR University

Judge said that despite no fault of the petitioner, she lost the seat

Hyderabad: B. Maheswari, an MBBS aspirant who moved the Hyderabad High Court said that the NTR University Health Sciences had taken all her originals, including certificates af-ter the provisional allotment and she had to report before the Government Medical College, Anantapur on or before May 31, 2013, but the college was closed from May 31 to September 15, 2013 due to the Samaikyandhra agitation.

The petitioner submitted that she stayed in Anantapur from May 31, onwards and daily attended college as well as the hostel for getting admission into the college as well as in the hostel. At last, the Hostel Warden issued an admission form and the petitioner paid an amount of Rs 10,000 and was allotted a room.

Despite several appeals, the college authorities denied her admission on the ground of not joining the college as per the provisional allotment and the Registrar of the NTR Varsity also confirmed the same when she met him along with her father.

She made a written request to the Registrar stating that because of the Samaikyandhra strike, she could not join, though she was physically present. She could not join on account of closure of the college and non-availability of staff in the college as well as the principal with effect from May 31, onwards. But the Registrar did not respond to her plea. After hearing the case, Justice A. Rajasekhar Reddy allowed the petition and found fault with the attitude of the NTR Varsity. The judge found that the petitioner stayed in Anantapur and ultimately succeeded in getting admission in the college hostel on September 13, and the varsity cancelled her admission on September 17 and allotted it to another student.

Referring to the rules of the varsity, the judge held that “until and unless a candidate wishes to withdraw from the course, no vacancy can be said to have arisen once the provisional admission order is granted by the University.”

The judge said that despite no fault of the petitioner, she lost the seat and directed the university to grant admission to her into the first year MBBS course forthwith in the 2014-15 academic year subject to paying necessary fees by her.
