Full bench to resolve judges jurisdiction
Hyderabad: To decide whether the existing judges of the common High Court have the power to deal with cases pertaining to Andhra Pradesh, the Chief Justice of Hyderabad High Court on Friday decided to constitute a full bench.
On June 20, Justice L. Narasimha Reddy had raised the question while dealing with a contempt case and directed the Union of India, Ministry of Law and Ministry of Home to clarify whether the existing judges of the common High Court have the power or not.
Sitaram Chaparla, a practicing advocate of the High Court, on Friday moved an appeal before the division comprising Chief Justice and Justice P.V. Sanjay Kumar against the order of the single judge as a lunch motion.
The Registry took objection stating that the petitioner was not a party to the petition in the contempt case pending before the single judge and had no right to move an appeal in the contempt case. The bench permitted the advocate to move the appeal in a LPA (Letter of Patent Appeal) and heard the case.
The Chief Justice said it would be proper to refer the case to a full bench comprising of three judges to answer the points raised with regard to the jurisdiction of the Common High Court. The Chief Justice directed the registry to place the proposal before him for constitution of the full bench.
